TERMS AND CONDITIONS OF USE
BY USING "LawyerFinder" YOU AGREE TO BE BOUND BY THESE
TERMS AND CONDITIONS OF USE. PLEASE READ THEM IN THEIR ENTIRETY.
IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS AND CONDITIONS
OF THIS AGREEMENT, DO NOT USE OR ACCESS OUR SERVICES.
LawyerFinder Lawyer Locator (the "Service") is
offered to users of the LawyerFinder.com Web site. It is operated
by Trumpet Marketing Group, LLC. The Service provides those
seeking legal services ("Inquiror") with the opportunity
to locate lawyers who subscribe to the Service and are interested
in providing legal services to the Inquiror ("Subscribing
Lawyers"). LawyerFinder does not review requests by Inquirors
or responses by Sponsoring Lawyers.
1. User Assumes Responsibility.
LawyerFinder does not warrant the validity and accuracy of information
submitted by Inquirors or Sponsoring Lawyers. LawyerFinder
does not guarantee the quality of any work product by Sponsoring Lawyers. LawyerFinder cannot ensure that a transaction will
occur. Further, if a transaction does occur, LawyerFinder has
no control over the quality, safety or legality of the item
or service sold. This service is free for Inquirors to use
in submitting requests and reviewing responses. All charges
associated with this service are incurred by Sponsoring Lawyers.
2. Disclaimer of Attorney-Client Relationship and Legal Representation.
Use of this Service does not create an attorney-client relationship
between a Sponsoring Lawyer and any Inquirors. That relationship
must be established outside the scope of this Service. The
Service offers no legal advice, recommendations, endorsements,
or legal representation of any sort. The Service merely offers
Inquirors a forum through which they may review a limited
choice of legal counsel. Each Inquiror is solely responsible
for making his, her, or its own selection of counsel. The
Service does not receive any portion of any legal fees or
costs charged by any Sponsoring Lawyer. Any fee arrangements
and legal services are strictly between the Inquiror and their
Sponsoring Lawyer and do not involve LawyerFinder in any way.
3. Avoid Disclosure of Confidential Information.
LawyerFinder has implemented security measures to try to prevent
any unauthorized interception of data, but because of the
nature of the World Wide Web any and all information provided
through this Service is subject to interception by third parties.
By continuing to use this Service you hereby acknowledge that
disclosure of electronic communications sent through the Service
may occur. Therefore, Inquirors should avoid disclosing any
privileged and/or specific information regarding matters for
which legal representation is sought. Specific information
would include, by way of example only, names of persons, businesses,
and facts that would readily identify the parties involved
in the legal issue or dispute. Inquiror should describe their
issue or dispute in the general terms only. Specific information
should only be revealed after the Inquiror has selected an
attorney and made contact outside the Service (e.g. via telephone
or appointment). Sponsoring Lawyers using the Service should
refrain from asking any Inquiror to reveal any specific or
confidential information through the Service.
4. Sole discretion with Inquiror and Sponsoring Lawyer.
Inquiror shall have sole discretion whether to contact any
Sponsoring Lawyer who responds to a request. Nothing in
this Service is intended or should be interpreted as directing
a Inquiror in the selection of an attorney or limiting the
ability of an attorney to use his or her own judgment in the
practice of law.
5. Conflicts Checks.
Inquiror understands that a Sponsoring Lawyer will not be
able to and will not perform a check for conflicts of interest
between the Inquiror and other clients of the Sponsoring Lawyer
prior to responding to a request. Conflict checks require
Inquiror to provide their name and contact information and
the identity of any affiliated entities, opposing individuals
and entities, and such other information as an attorney may
require. Conflict checks by Sponsoring Lawyers who obtain
information from Inquirors through this Service are not possible
since submissions by an Inquiror to the Sponsoring Lawyer
are anonymous and the description of the matter by the Inquiror
is required to be general in nature.
6. Release.
Inquirors and Sponsoring Lawyers hereby release, acquit
and forever discharge LawyerFinder from any and all claims, demands,
losses, injuries, liability, or damages of any kind and nature,
whether known or unknown, suspected or unsuspected, disclosed
or undisclosed, arising out of or in any way connected with
the Service, any disclosure resulting from your use of the
Service, any conflict of interest, ethical violation, or any
alleged malpractice arising out of any Inquirors use of the
Service in locating a Sponsoring Lawyer. If you are a California
resident, you waive California Civil Code §1542, which
says: "A general release does not extend to claims which
the creditor does not know or suspect to exist in his favor
at the time of executing the release, which if known by him
must have materially affected his settlement with the debtor
7. LIMITATION OF LIABILITY.
IN NO EVENT SHALL LawyerFinder OR ITS PARTNERS BE LIABLE FOR
LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES
ARISING OUT OF OR IN CONNECTION WITH THIS SERVICE, Some states
do not allow the exclusion or limitation of incidental or
consequential damages, so the above limitation and exclusions
may not apply to you.
8. WARRANTY DISCLAIMER.
You use the Services at Your own risk. THE SERVICE IS PROVIDED
ON AN "AS IS, AS AVAILABLE" BASIS. NEITHER LawyerFinder
NOR ANY OF ITS PARTNERS MAKES ANY WARRANTIES, EXPRESS OR IMPLIED,
WITH RESPECT TO THE SERVICES OR ANY CONTENT OR PRODUCTS, AND
HEREBY DISCLAIMS ANY IMPLIED WARRANTIES, INCLUDING, WITHOUT
LIMITATION, THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE AND NON-INFRINGEMENT.
9. GENERAL.
This agreement constitutes the entire agreement between Inquiror
and LawyerFinder, provided that LawyerFinder may amend this Agreement
at any time by posting the amended terms and conditions on
the Site. The rights and obligations of the parties under
this Agreement shall be governed in all respects by the laws
of the State of California without regard to its conflict
of law provisions. The Superior Court of Santa Clara County
and/or the United States District Court for the Northern District
of California will have exclusive jurisdiction and venue over
all controversies in connection herewith, and each party hereby
consents to such exclusive and personal jurisdiction and venue.
No agency, partnership, joint venture, or employment is created
as a result of this Agreement and You do not have any authority
of any kind to bind LawyerFinder in any respect whatsoever
